The Kabalikat Civic Communicators Association, Inc. or simply known as KABALIKAT CIVICOM, is the Philippine's largest and most active communications group today. It has more than 900 chartered chapters nationwide stretching its base from as far as Aparri in northernmost Luzon to Davao Oriental, Saranggani Province, the Zamboanga Peninsula in the open south of Mindanao and other chapters abroad. Kabalikat is a non-stock, non-profit civic organization whose noblest motive is the public welfare. It was conceived and organized in December 1990 to primarily raise the status of communicators to a position of high responsibility and importance and to enable radio enthusiasts to actively participate in public assistance particularly during calamities and emergencies or whenever there is a need to ensure public comfort and convenience. Members of Kabalikat strive to live by the following Code of Discipline: 1) commitment to the public, 2) faith, love and belief in God, 3) love of country, 4) respect for the authorities and the government, 5) commitment to democracy, and 6) responsiveness to the public. The organization has also the following objectives of its existence which is: a) to foster stronger and more cohesive fellowship and cooperation among those involve in community radio communication, b) to develop dedication, discipline and professionalism in community services, c) to promote the bayanihan spirit, mutual help and cooperation among various government agencies and civic-minded organizations by bringing its services closer to every sector of the community, and d) to assist in everyway possible in the developmental radio communication in the national endeavor of achieving reforms. Kabalikat is registered with the Securities and Exchange Commission (SEC) on January 1994 under Registration Number ANO-94-339 and is also registered with the National Telecommunications Commission (NTC) under License Number 58489, Station Call Sign 4DW-656, Class FB-0366-95.

 | THE CORPORATION CODE OF THE PHILIPPINES - BPB 68
TITLE II - INCORPORATION AND ORGANIZATION OF PRIVATE CORPORATIONS
Sec. 18. Corporate name. -
No corporate name may be allowed by the Securities and Exchange Commission if the proposed name is identical or deceptively or confusingly similar to that of any existing corporation or to any other name already protected by law or is patently deceptive, confusing or contrary to existing laws. When a change in the corporate name is approved, the Commission shall issue an amended certificate of incorporation under the amended name.
Comment: Why is it that Kabalikat Bikol was able to register at the SEC when there is an standing law against duplication of names to be registered. Let us point out the following:
1. Kabalikat Civicom in nature is a radio group likewise Kabalikat Bicol.
2. Kabalikat Civicom is registered under SEC Registry #ANO94-000339 which is on the regular list and revalidated recently by a decision issued last year 2008 by SEC.
3. Kabalikat Bicol was permitted to register on a SEC Registry CN #2006-26769 though on a reserve list only.
3. It clearly shows that Kabalikat Civicom is the first to be registered among the two.
4. Why is it that Kabalikat Bicol or Kabalikat Mediacom or KabalikatNet Philippines or whatever Kabalikat names they invoke was permitted to register at SEC and continues to operate under the name Kabalikat which is all in nature a radio communication group?
5. That the existing situation is a violation of the Corporate Code of the Philippines BPB #68 Title II Section 18.
6. Why is it that there is no stringent screening of organizations whenever they register at SEC in terms of names.
7. The said discrepancy contributed to Kabalikat Civicom finding itself in the losing end of proper recognition of its well earned awards and recognition because some other organizations claimed it for themselves. (Though we are not that persistent to have such.)
8. That there was a confusion brought about the said violation of BPB 68 to non-members thinking it was Kabalikat Bicol to the detriment of Kabalikat Civicom.
9. To think that Kabalikat Bicol is only a break away of Kabalikat Civicom.
10. We, Kabalikat Civicom are not prohibiting Kabalikat Bicol to do humanitarian services which we have been doing for more than 15 years. We are only disuading them from using Kabalikat as the name of their group since they have already renounced that name since they parted from Kabalikat Civicom. We are prohibiting them from capitalizing from the name of Kabalikat since they no longer represent Kabalikat.
11. Whatever you do, good or bad reflects on the name kabalikat the group where you originated, which is detrimental to the reputation of our group the Kabalikat Civicom. Be Original! Do not capitalize from using the name KABALIKAT (whatever nouns or adjectives or aconyms you add on it)! THE WORD KABALIKAT when used for radio communication and volunteer groups are for the SOLE USE of KABALIKAT CIVICOM ASSOCIATION, INC.
12. That it clearly shows that Kabalikat Bicol continues to use Kabalikat to capitalize on the Kabalikat Civicom's prestigious name and use it for deceptive purposes. It is easy to get sponsorship and solicitation from people when you use Kabalikat as your organization. That it was one of our reason from requesting the SEC to ban or prohibit Kabalikat Bicol or any other volunteer radio communication group not connected in any way to Kabalikat Civicom from using the name Kabalikat to avoid any misrepresentation. |
